This week, host and AABD President David Baris is joined by Ken Thomas, one of the leading experts on CRA in the country. If he doesn’t know the answer, no one does. He also is the president of Community Development Fund Advisors and serves as a director of a community bank in New York and as Chair of the Nominating and Corporate Governance Committee. He was a lecturer at Wharton for 42 years.
Ken will discuss CRA, fair lending, and fair banking in light of the anticipated challenges from the new Biden administration. He will provide advice on how bank boards can play an important role in overseeing this risk and helping their bank meet not just responsibilities under law but also to the community.
As Ken says in the podcast episode, if it hasn’t happened yet, it will. This should be a front burner issue for bank directors.

This week, host and AABD President David Baris is joined again by Tom Fitzgerald to conclude their discussion on how to prepare for your next bank examination. Tom will discuss the human interaction between a bank and an examiner that can be crucial to the results - there is more to an examination than just the facts.
Tom was a National Bank Examiner and Senior Executive at the Comptroller of the Currency, then a Senior Consultant at Promontory. He examined numerous national banks during and after the S&L crisis and supported rehabilitation efforts for many of them, and at Promontory, he assisted banks to address regulatory concerns with their financial condition.

This week, we're joined again by Lynda Bennett, Chair of the Insurance Recovery Group and member of the Executive Board at Lowenstein Sandler. With 25 years of experience, Lynda represents banks and other corporate policyholders on reviewing and negotiating the terms of D&O policies and other insurance policies, and litigating, negotiating, and resolving complicated disputes with insurers.
In this episode, Lynda provides extraordinary insight into how banks and their directors can successfully access their coverage; the importance of understanding the scope of the bank's indemnification of directors and officers before the policy terms are finalized, how the definition of "claim" in the policy may affect coverage for regulatory investigations and other matters, how to properly and timely file and manage a claim, and how to negotiate the language in the policy without necessarily increasing the cost of the coverage.
